After the death of a loved one, the grieving family is often confronted with a host of issues to deal with, including how to properly deal with their loved one’s estate. Whether a loved one had a will or died without a will (i.e., intestate), the procedures to properly close the estate and distribute the assets to family members and other beneficiaries may require court-supervised probate and estate administration proceedings. Once appointed by the court, the executor (or administrator) is generally responsible for handling the affairs of the estate.

The Executor or Administrator’s responsibilities typically include:

  1. Gathering all of the loved one’s assets and keeping an inventory of all assets and liabilities of the decedent;

  2. Notifying the decedent’s heirs and beneficiaries;

  3. Managing the estate’s property, including the potential sale of property;

  4. Payment of taxes and debts; and

  5. Distributing the decedent’s property to heirs and beneficiaries.
